These terms apply when you use Platinum Apps, the online tools run by Platinum Consultants Aust Pty Ltd (“Platinum Consultants”, “we”, “us”). That includes the Overhead Calculator, the Simpro health check, the catalogue, prebuild and archiving tools, the Platinum Edge membership, the Academy, and anything else we offer at this address (together, “the Service”). By creating an account or using the Service you agree to these terms. If you are using it for a business, you agree for that business and confirm you are allowed to.
1. Your account
- Give us accurate details and keep them up to date.
- Keep your password and any two-step sign-in device safe. You are responsible for what happens under your login.
- The owner of a workspace decides who else can use it. You are responsible for the people you invite and for removing access when someone leaves.
- Tell us straight away if you think someone else has used your account.
2. Connecting your Simpro
Many tools work by connecting to your own Simpro system with an API key or login that you create in Simpro and give to us. By connecting, you confirm you are authorised to give that access for your business.
- Reports such as the health check read your Simpro data. They do not change it.
- Some tools change your Simpro data, for example archiving catalogue items, updating prices or labour rates, importing prebuilds or public holidays. They only do so when you, or someone in your workspace, start them. Where a tool offers a preview, check it before you confirm.
- Simpro is run by a separate company. We are not responsible for its availability, its changes or its data. Keep your own backups of anything important.
- You can remove the connection at any time, in the Service or by revoking the key in Simpro.
3. Connecting your accounting system
You can connect Xero or MYOB (and other systems such as QuickBooks where we offer them) so the Service can read figures such as your profit and loss. You authorise that connection with the provider directly, and you can disconnect at any time. Those providers’ own terms apply to your use of their systems.
4. Your data
Your business data stays yours. You give us permission to store and process it only as needed to run the Service for you, to support you, and to keep the Service secure. You are responsible for having the right to give us the data you enter or import, including information about your employees. How we handle personal information is set out in our Privacy Policy.
5. Payments
- Paid apps and memberships are billed through Stripe. Prices are shown before you buy and include GST where it applies.
- Subscriptions renew automatically at the end of each period until you cancel. Cancelling stops the next renewal; you keep access until the end of the period you have paid for.
- Except where the law requires (including the Australian Consumer Law), fees already paid are not refundable.
- Promotional and member codes give the discount or access stated for that code. They cannot be transferred, and they may expire or be withdrawn.
- If a payment fails we may pause access until it is sorted out.
6. Using the Service properly
Please do not misuse the Service. That includes trying to get into accounts or data that are not yours, interfering with its security or performance, reverse engineering it, reselling it without our written agreement, uploading anything unlawful or harmful, or using it to break someone else’s rights.
7. Results are a guide, not advice
Calculations, health-check findings, benchmarks and suggestions are tools to help you decide. They depend on the data in your systems, which may be incomplete. They are not financial, tax, legal or employment advice. Check the results and get professional advice before relying on them for an important decision.
8. AI features
Some features use artificial intelligence to draft or summarise text, such as email replies, lesson notes or explanations of a report. Any figures you see are worked out by the Service itself; the AI only writes words. AI can still get things wrong, so read what it drafts before you use or send it.
9. Courses, recordings and other content
Academy lessons, templates, reports and other material we provide are ours or our licensors’. You may use them within your own business while you have access. Please do not copy, share or sell them outside your business.
10. Changes and availability
We keep improving the Service, so features change. We aim to keep it available, but we cannot promise it will always be uninterrupted or error free, and we sometimes need to take it down for maintenance. If we make a change that materially reduces what you have paid for, we will tell you.
11. Our responsibility to you
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Apart from those rights, and to the extent the law allows:
- we are not liable for indirect or consequential loss, or for lost profit, revenue or data;
- we are not responsible for loss caused by third-party systems (such as Simpro, your accounting system or your internet provider), or by changes made in your systems by a tool you chose to run; and
- our total liability to you is limited to the fees you paid us for the Service in the 12 months before the claim, or, where the law allows, to supplying the Service again.
12. Ending your use
You can stop using the Service at any time. The owner of a workspace can delete the account from within the Service, which permanently removes its data (see our Privacy Policy). We may suspend or close an account that breaks these terms, puts the Service or other customers at risk, or is not paid for, and we will tell you why unless the law or security prevents it.
13. Changes to these terms
We may update these terms. The date at the top shows when they last changed. If a change is significant we will let account owners know before it takes effect. Continuing to use the Service after that means you accept the new terms.
14. The law that applies
These terms are governed by the laws in force in Australia, and the courts of Australia have jurisdiction over any dispute about them.
