These Terms of Service ("Terms") govern your access to and use of the Overhead & Employee Cost Calculator (the "Service") provided by Platinum Consultants (Aust) Pty Ltd ("Platinum", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
The Service helps you calculate employee costs and a company overhead rate, and (optionally) connect to Simpro and Xero to import data and push results. The Service provides calculations and tools for your own decision-making; it is not accounting, tax, financial or legal advice. You are responsible for verifying figures before relying on them.
You must provide accurate account details and keep your login secure. You are responsible for activity under your account. A subscription covers a single business login, which may hold multiple client workspaces where permitted by your plan. Platinum support staff may access your workspace to provide assistance; such access is limited to nominated staff and logged.
Access is provided on a subscription basis billed through our payment processor, Stripe. Unless stated otherwise, each subscription term grants access for the stated period (currently 3 months) and renews automatically until cancelled. Prices are in Australian dollars and, where applicable, GST is shown at checkout. You can cancel or manage your subscription at any time via the billing portal in your account; cancellation stops future renewals and you retain access until the end of your current paid period.
Promotional or member codes may grant discounted or complimentary access on the terms stated for that code. Codes are non-transferable and may be withdrawn or expired at our discretion.
To the extent required by the Australian Consumer Law, nothing in these Terms excludes rights or remedies that cannot lawfully be excluded. Outside those rights, subscription fees are generally non-refundable except at our discretion. Where a refund is issued, access to the Service may be revoked.
If you connect Simpro or Xero, you authorise the Service to access and exchange data with those services on your behalf. Your use of Simpro and Xero remains subject to their own terms. We are not responsible for those third-party services.
You must not misuse the Service, attempt to breach its security, use it unlawfully, or upload data you are not entitled to use. We may suspend accounts that breach these Terms.
You retain ownership of the data you enter. You grant us the licence needed to host and process it to provide the Service. Our handling of personal information is described in our Privacy Policy.
We aim to keep the Service available but do not guarantee uninterrupted access. We may update, improve or modify features over time, and may change these Terms by posting an updated version; continued use after changes means you accept them.
To the maximum extent permitted by law, the Service is provided "as is", and our liability for any claim arising from the Service is limited to the amount you paid for the Service in the 3 months before the claim. We are not liable for indirect or consequential loss. Nothing limits liability that cannot be limited under the Australian Consumer Law.
These Terms are governed by the laws of [STATE], Australia, and the courts of that jurisdiction have exclusive jurisdiction.
